Notice/Acceptance of Terms: This Terms of Use Agreement (the “Agreement”) is a contract between you and Joyous Justice. Joyous Justice operates the website found at the address www.joyousjustice.com and https://joyous-justice.mykajabi.com (the “Sites”). This Agreement governs your use of the Sites. Be sure that you carefully read and fully understand this Agreement. Joyous Justice is willing to provide you with access to the Sites only on the condition that you accept all of the terms and conditions (the “Terms”) contained in this Agreement. This Agreement governs your use of the Sites. Please read all of the Terms carefully. By using the Sites, you agree to comply with and be bound by these Terms. If you do not agree to the Terms, you are not authorized to use the Sites. Joyous Justice reserves the right to modify the Terms at any time by posting a notice on the homepage of the Sites. Your use of the Sites after the notice is posted indicates you agree to the changes.
The Whiteness Havruta (WH) community is your space to connect, create, share, and inspire. Our goal for this group is for WH participants (WHniks) to get support, and offer support to each other. It's up to us to keep the official WH community a safe, brave, accepting, and encouraging space for everyone, so please read and agree to the guidelines below. In the near future, you'll receive an email with a link to join the WH Facebook Group.
Whiteness Havruta is primarily an intensive leadership and social justice educational learning experience, not an institutional change cohort. The participant understands that the impact of the program on them will depend on the degree to which they invest their time, energy, and focus into the program (group webinars, Q&A sessions, readings, weekly havruta sessions, Facebook group participation, etc.). Joyous Justice Facilitators’ availability will be limited to the hours specified in the program calendar.
Be Kind: We have a zero tolerance policy for negativity, bullying, drama, gossip, or toxic energy. Encourage and support your fellow WHniks. Never make anyone feel unwelcome or judged; treat everyone with love and acceptance. If you disagree or have an opposing viewpoint to share, do it with respect, honor, and from a place of compassion. Spirited debate about ideas or concepts is awesome, personal attacks are not. If you can’t be kind, be quiet. Violation of this rule is grounds for immediate and permanent removal from the community without a refund.
No Disparaging: This is a no venting zone: about Catherine, April, the Joyous Justice Team, the WH program, or anyone else, WHnik or not. We don’t put anyone down, be it other programs, teachers or people. This applies to issues with other WHniks as well. Do not create drama by posting “A certain WHnik did X and I’m so upset” or “Someone in this group did Y, that wasn’t cool.” If you have an issue or grievance — either with the program, or each other, bring it directly to the party you have an issue with. Find resolution. It’s the adult and responsible thing to do. If you feel it’s important for us to know, please take screenshots, collect your records of the transactions or communications, and write [email protected]. We encourage accountability and will take action if necessary.
Be Generous: Give more than you ask. Share what you’re working on, but keep a larger emphasis on sharing support, wisdom, and encouragement. Think 3:1. Give 3X more support, insight, and encouragement than you ask for.
Don’t Promote Your Work or Services: The primary intention of the community is to stay connected to your fellow participants, share ideas, get and give support, and to form genuine connections. It’s not a place to find customers, or recruit people to other programs or groups (even free ones). Be upfront, clear, and honest. Share from a place of learning and helping, and use this community as an educational support system. If you promote yourself or your services, your post will be removed.
Be Ethical & Original - Intellectual Property Policy: Joyous Justice will be recording the webinar and Q&A sessions included in the program; one-on-one Havruta paired learning sessions will not be recorded, and breakout room conversations will also not be recorded. All program materials, including videos recorded of live sessions, are the intellectual property of Joyous Justice and can be used at the discretion of Joyous Justice for promotional and future educational purposes. Once released, program materials will be available to participants for the duration of the six months program and the six months following the program, which coincides with the calendar year 2021. This provision shall survive termination of this agreement.
Also, don’t copy, steal or share other people’s intellectual property. Don’t reuse or repurpose other WHniks’ content. If you have a question or case of infringement, write to the party directly. Be sure to take screenshots and capture all communication to prove your case. If you need further assistance, write to us directly at [email protected]. We take these issues seriously and it is grounds for possible removal from the program and community. If we find that you are only here to take others’ work as your own, this is NOT the place for you and you will be removed without refund.
Don’t Spam, Mass Mail or Violate Privacy. Never email or contact other members without their permission, or add people to your newsletter list. Violating this is grounds for immediate removal without refund. If in doubt — write [email protected]. We’re always here to help finesse any situation; better safe than sorry.
Do Your Due Diligence: If you decide to hire anyone or create any contractual relationship (verbally or written) with someone you’ve met through your participation in Whiteness Havruta, you do so at your own risk. Please do your due diligence and always get clear, written contracts and service agreements in place. While we love to believe everyone in the world is honest and ethical, that’s just not the case. Whiteness Havruta, Joyous Justice, Catherine Bell Consulting and/or April Baskin and Catherine Bell are not responsible for any loss of revenue, damages, breach of contract, or any other unfavorable circumstance as a result of that relationship.
Program Fees: You and/or your organization’s payment covers your access to all program materials for the duration of the 6 month program and for the remainder of the calendar year of 2021. Individual participants are expected to pay a fee of $360 (on a sliding scale ranging from $180 to $540).
Your results in your leadership/business will be completely dependent on your understanding of the material and your effort to apply it. If paying by credit/debit card, you give Joyous Justice permission and authorization to automatically charge your credit or debit card as payment for your Whiteness Havruta Program trainings, Products, or Services for which you will receive an electronic receipt. If you purchase a Whiteness Havruta training, Product, or Service using our payment plan option, you agree to pay the initial payment to secure your participation and also agree to begin payments on the date specified on the enrollment form. By using the enrollment form, you give Joyous Justice permission and authorization to automatically charge your credit/debit card every thirty (30) days until all payments are completed.
In the event that payment is not received by the date due, you will have a seven (7) day grace period to make the payment otherwise the Whiteness Havruta Program trainings, Products or Services will not continue. If you fail to make payment in a timely manner in accordance with these Terms and Conditions or voluntarily decide to withdraw from our Whiteness Havruta Program training, Products or Services at any time or for any reason whatsoever, you still will remain fully responsible for the full cost of the Whiteness Havruta Program trainings, Products and/or Services.
When you enroll in the Whiteness Havruta Program training, Product or Services, the information provided and obtained as part of the transaction, such as your credit card number and contact information, may be collected by both the third-party merchant (such as the online course platform and online payment platform) and by us. A merchant may have privacy and data collection practices that are different from ours. We have no responsibility or liability for the merchant’s independent policies.
You agree to be financially responsible for all purchases made by you. You agree to purchase and use our Whiteness Havruta Program trainings, Products or Services for legitimate purposes only in compliance with these Terms of Use. You also agree not to make any purchases for speculative, false or fraudulent purposes. You release us and our affiliates from any damages that you incur and agree not to assert any claims against us or them, arising from your purchase or use of our Whiteness Havruta Program trainings, Products or Services.
Refund Policy: Your satisfaction with Whiteness Havruta is important to us. Yet, because of the extensive time, effort, preparation and care that goes into creating and/or providing our training, products and services, you acknowledge that we do not offer refunds for any portion of your payment for any of our Whiteness Havruta trainings, Products or Services.
Photo/Video Waiver: You hereby irrevocably grant to Joyous Justice the right to include your name, biographical information, image, photograph, and any video in which you appear on Joyous Justice’s (or an affiliated entity’s) website, internal and external brochures and newsletters, and in any other promotional, advertising or educational materials Joyous Justice may create or use in connection with its programs. This provision shall survive termination of this agreement.
Term/Termination: This agreement shall terminate automatically on December 31st, 2021.
Entire Agreement: This agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written.
Severability: If any provision of this agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.
Applicable Law: This agreement shall be governed by the laws of the State of District of Columbia.
